רישום משפטי (מס' 48) בפנקס בית דין רבני בקהיר. בעברית. מיקום: קהיר. מתוארך לכ"ג באייר ה'תמ"ג, הוא שנת 1683 לסה"נ. (מסמך מס' 48) יישוב סכסוך מורכב ומקיף הקשור לאותו הסדר כתובה, ירושה ובעלי דין מתוך מסמך מס' 46 (PGPID 40924): סת אלבית בת יוסף פנג'י(?), אלמנתו של שמואל טייב המכונה חאג', יחד עם ארבעת בניה החיים — יוסף, יצחק, יעקב וחיים (הבן אברהם כבר נפטר). השורות הפותחות של התיק מסבירות כי בעלה של סת אלבית הותיר במותו חובות בלתי מסולקים אצל גוי אחד שאינו מצוין בשמו, "סכום גדול הרשום בדפתר... קרוב ל-20,000 מדין", שעל בניה היה לסלקו ולשלמו בבית המשפט. האחים זכו גם בתביעה שנייה שהוגשה נגדם על ידי גוי בלתי מזוהה, אשר טען כי בית הדירות הגדול שהיה כלול בעיזבון משפחת טייב הוא למעשה רכוש הקדש (וקף) ושהם אינם הבעלים החוקיים שלו. תיק שני זה בבית הדין של הקאדי עלה למשפחה 10,000 מדין, אותם הוציאו על שיפוצים בנכס (מתוך הוכחת בעלותם דרך החזקה והאחזקה) ועל השגת ח'ג'ה (תעודה משפטית) שאישרה כי לא קיים מסמך וקפיה התומך בכל טענה נגדית כלפי בעלותם החוקית. האחים שילמו את האגרות בשני התיקים מנכסיהם הפרטיים, ולא באמצעות מימוש חלק כלשהו מעיזבון אביהם. דף 13r (המשך מסמך מס' 48): לאחר שסילקו את חובות אביהם, אחד מחמשת האחים טייב נפטר והותיר אחריו שלושה ילדים ואלמנה — אסתר בת שלום טייב (שככל הנראה הייתה בת דודתו מצד האב). כאשר סת אלבית ניסתה לראשונה להישבע שבועת אלמנה ולקבל את מלוא ערך כתובתה (70,000 מדין), פרצה מריבה משפחתית בינה לבין ארבעת בניה הנותרים וכלתה אסתר. סת אלבית מינתה שני אנשים בייפוי כוח לייצגה בתיק: יוסף הכהן וחתנו נתן בן אפרים. שני הצדדים הגיעו לפשרה בנוגע לערך כתובתה של סת אלבית, לפיה היא קיבלה 50,000 מדין אך ויתרה על כל תביעה ל-20,000 מדין שערכם חתולי מושק (זבאד) ונכסים ברובע הקראי (רכוש המוזכר גם במסמך מס' 46). הבעלות על חתולי המושק והנכסים חולקה לחמישיות בין ארבעת האחים לבין אסתר אלמנת אברהם. ארבע נשות בניה של סת אלבית והאלמנה תרמו כל אחת 4,000 מדין מנדונייתן (סך הכול 20,000 מתוך 50,000) כחלקן בפשרה עם חמותן. דף 13v (המשך מסמך מס' 48): השורות האחרונות של יישוב הסכסוך בין סת אלבית לבניה וכלותיה. חלק זה כולל את שמות אבותיהן של ארבע כלותיה האחרות של סת אלבית: מרים בת משה טייב (אשת יוסף), אסתר בת יהודה הכהן (אשת יצחק), רחמה בת דוד טייב (אשת יעקב), וחביבה בת אברהם [ללא שם משפחה רשום] (אשת חיים). לאור החזרה של שם המשפחה הלא-שכיח, סביר להניח כי שלושה מן האחים טייב נשאו את בנות דודיהם מצד האב (אסתר בת שלום טייב, מרים, ורחמה).

Princeton Geniza Project description: Legal record (#48) in a court register/pinqas from a Rabbanite beit din in Cairo (on ff. 12v-13r-v of BL OR 6356). In Hebrew. Location: Cairo. Dated 23 Iyyar 5443 AM, which is 1683 CE. (Document #48) Complex and extensive dispute resolution involving the same ketubba settlement, inheritance, and parties from document #46 (PGPID 40924): Sitt al-Bayt bt. Yosef Fanji(?), widow of Shemuʾel Ṭayyib aka Ḥajj, in addition to her four living sons Yosef, Yiṣḥaq, Yaʿaqov, and Ḥayyim (the son Avraham is already deceased). The opening lines of the case explain how Sitt al-Bayt's husband left outstanding debts with an unnamed non-Jew at the time of his death, "a large sum recorded in a defter... close to 20,000 medin" that her sons had to settle/pay in court. The brothers won a second suit that was brought against them by an unnamed non-Jew, who claimed that the large apartment building in the Ṭayyib family inheritance was in fact waqf property and they were not the rightful owners. This second qadi court case cost the family 10,000 medin, which they spent on repairs to the property (asserting their ownership via upkeep) and in securing a ḥujja which verified that there was no waqfiyya document supporting any counter-claim against their rightful ownership. The brothers paid the fees for both cases with their own assets rather than by liquidating any part of their father's estate. Folio 13r (Document #48 contd.) After settling their father's debts, one of the five Ṭayyib brothers died leaving three children and a widow Esther bt. Shalom Ṭayyib (who was likely his paternal cousin). When Sitt al-Bayt first tried to take the oath of widowhood and receive the full valuation of her ketubba (70,000 medin) a family feud unfolded between her, the four surviving sons, and her daughter-in-law Esther. Sitt al-Bayt appointed two men with power of attorney to represent her in the case: Yosef ha-Kohen and his son-in-law Natan Ben-Efrayim. The two sides reached a compromise regarding Sitt al-Bayt's ketubba valuation, by which she received 50,000 medin but relinquished any claim to the 20,000 medin worth of civet cats and properties in the Karaite quarter (possessions also mentioned in document #46). Possession over civet cats and property was divided in fifths between the four brothers and Avraham's widow Esther. The four wives and widow of Sitt al-Bayt's sons each contribute 4,000 medin from their own dowries (a combined 20,000 of 50,000) toward the compromise with their mother-in-law. This section includes the patronymics of Sitt al-Bayt's other four daughters-in-law: Miryam bt. Moshe Ṭayyib (Yosef's wife), Esther bt. Yehuda ha-Kohen (Yiṣḥaq's wife), Raḥma bt. David Ṭayyib (Yaʿaqov's wife), and Ḥabība/Havīva bt. Avraham [no surname listed] (Ḥayyim's wife). Given the recurrence of their uncommon surname, it is likely that three of the Ṭayyib brothers married their paternal cousins (Esther bt. Shalom Ṭayyib, Miryam, and Raḥma). MCD.
