רישום משפטי (מס' 83) בפנקס בית דין קראי בקהיר (בדף 29r). מתוארך ל-17 באלול ה'שכ"ה (1565). מדובר בתיק של סכסוך נישואין שהסתיים בגירושיהם של אברהם בן דוד הלוי וחנה בת משה אלמע'רבי. הרישום מציין כי בין בני הזוג התרחשו "מריבה והכאה", ועל כן אברהם נותן לאשתו גט. על פי מבנה התיק, ייתכן שאברהם נשבע במסגרת יישוב סכסוך נישואין קודם או בתנאי האירוסין/הכתובה שלהם, שאם ירים יד על אשתו אי פעם שוב — תוכל היא לתבוע גירושין בבית הדין. חנה, מצדה, משחררת את בעלה מחובת החזרת נדונייתה ופריטי שלל בגדיה ורכושה האישי. הרישום מציין לאחר מכן, באופן מעט פתאומי, כי כמות של יין התקבלה על ידי בית הכנסת דאר סמחה. סביר להניח שמדובר בקנס שאברהם נדרש לשלם בגין הפרת תנאיו של יישוב סכסוך קודם או של הסכם האירוסין (בדומה למשל לתעודה PGPID 41609). במסמכי הגניזה הקראיים מן העת החדשה המוקדמת, קנסות מסוג זה מופיעים בדרך כלל כתרומות/קנסות של שמן זית לבית הכנסת דאר סמחה.
Princeton Geniza Project description: Legal record (#83) in a court register/pinqas from a Karaite beit din in Cairo (on f. 29r of Yevr.-Arab. I 328). Dated 17 Elul 5325 AM (1565 CE). Marital dispute case resulting in the divorce of Avraham b. David al-Levi and Hanā bt. Moshe al-Maghribī. The record notes that a "quarrel and beating" took place between the couple and, thus, Avraham grants his wife a divorce. Based on the case's structure, Avraham may have sworn an oath in a previous marital dispute resolution or in their betrothal/ketubba conditions that if he raised a hand to his wife ever again, then she would be able to seek a divorce in court. Hanā, in turn, releases her husband from the obligations of returning her dowry and trousseau items. The record then notes, somewhat abruptly, that a quantity of wine was received by the Dār Simḥa Synagogue. This was likely a fine that Avraham had to pay for breaking the terms of a previous dispute resolution or betrothal (akin to PGPID 41609, for example). In early modern Karaite geniza documents, these penalties more commonly appear as contributions/fines of olive oil to the Dār Simḥa Synagogue. MCD.
