תיאור
מסמך משפטי הנוגע למכירת נכס מקרקעין ברובע הקראי. בעברית. המקום: קהיר. התאריך: יום שני, כ' באב ה'תל"ו (1676 לסה"נ; ולא 1646 לסה"נ, כפי שמצוין במטא-דאטה של "כתיב"). הסופר הוא צפניה זרחיה. המסמך משתרע על פני 91 שורות, ונמנה עם המסמכים המשפטיים הארוכים ביותר מן הגניזה של ראשית העת החדשה. כששים השורות הראשונות מגוללות את שרשרת העסקאות וחלוקות הנכס שקדמו למכירה הנוכחית, כשהמוקדמת ביניהן מתוארכת לשלושים שנה קודם לכן — ו' באייר ה'ת"ד (1644 לסה"נ) — אז עבר הנכס בין בני משפחת באג'ילייר, אל ח'ליפה באג'ילייר ואשתו שמחה בת דוד באג'ילייר (ככל הנראה בני דודים מצד האב). שמחה מוכרת חלק מן הבניין לחיים בן יהודה הלוי צבי — דירה בקומה העליונה ופינת ישיבה קטנה — וכל הצדדים מסכימים על תנאי תשלום שכר הדירה לבעלי הבית המשותפים שלהם (שורות 24–26). חיים ואשתו ג'מילה בת משה אלטורטוס התגרשו לאחר מכן, וג'מילה קיבלה את הנכס הנדון כחלק מסידור כתובתה. לאחר מותה של ג'מילה ירשה את הדירה ואת פינת הישיבה בתה חנונה בת עמנואל אורחה (ככל הנראה ג'מילה נישאה בשנית לאחר גירושיה). חנונה מכרה בסופו של דבר את חכירת המשנה של הנכס בסיוון ה'תל"ג (1673 לסה"נ), אך רכשה אותו מחדש תמורת 1,500 מדין יום אחד לפני הנפקת מסמך זה בשנת 1676 לסה"נ. מטרת המסמך מתבהרת בשורה 60: חנונה ובעלה יצחק חלפון מוכרים מחדש את הדירה ואת פינת הישיבה יום אחד לאחר רכישתן. הקונה הוא משה שומר, המשלם לבני הזוג 1,500 מדין (באופן מפתיע — אותו מחיר עצמו ששולם יום קודם לכן). משה שומר מופיע גם במסמכים אחרים מסוף המאה השבע-עשרה, וכך גם הסופר צפניה זרחיה.
Princeton Geniza Project description: Legal document concerning a real estate sale in the Karaite quarter. In Hebrew. Location: Cairo. Dated: Monday, 20 Av 5436 AM, which is 1676 CE (not 1646 CE, as stated in Ktiv metadata). The scribe is Ṣefanya Zerḥīya. Totaling to 91 lines, this is one of the longest legal documents from the early modern geniza. The first ~60 lines recount the succession of previous transactions and divisions of the property, with the earliest one dating back thirty years to 6 Iyyar 5404 AM (1644 CE) when the property passed between members of the Bagilyer (באג'ילייר) family to Khalifa Bagilyer and his wife Simḥa bt. David Bagilyer (likely paternal cousins). Simḥa sells part of the building to Ḥayyīm b. Yehuda ha-Levi Ṣevi, an upper-story apartment and small sitting area, and they all agree to terms of paying rent to their shared landlords (ll. 24-26). Ḥayyīm and his wife Jamīla bt. Moshe al-Ṭorṭos later divorced, and Jamīla received the property in question as part of her ketubba settlement. After Jamīla died, the apartment and sitting area were inherited by her daughter Ḥanūna bt. ʿImmanuel Oreja (evidently Jamīla remarried after her divorce). Ḥanūna eventually sold the property sublease in Sivan 5433 AM (1673 CE) but later repurchased it for 1,500 medin the day before this document was issued in 1676 CE. The purpose of this document becomes clear in l. 60, where Ḥanūna and her husband Yiṣḥaq Ḥalfon resell the apartment/seating area one day after purchasing them. The buyer is Moshe Shomer, who pays the married couple 1,500 medin (the same price as the previous day, surprisingly).
