שטר מכר של חלק מבית. מקום: פוסטאט. תאריך: עשרת הימים הראשונים של חודש אייר ד'תתמ"ז למניין השטרות = אפריל 1136 לסה"נ. (התאריך השתמר חלקית בשורה 49, והשנה מופיעה באותיות קטנות סביב חתימתו של הדיין נתן ב"ר שלמה הכהן.) השטר נכתב בכתב ידו של חלפון ב"ר מנשה. סת אלבנאת בת שלמה (סלאמה) אלעטאר ירשה שישית מבית בשכונת אלממצוצה שבפוסטאט מבעלה המנוח אבו אלעלא בן דאוד. שאר חלקי הבית שייכים להקדש ולכהן המכונה אבן אבו אלח'ראסאן. האלמנה מוכרת את חלקה בבית לדוד הכהן תמורת 11 דינרים. הקונה מקבל לידיו את צוואת הבעל ואת כל שטרי הבעלות הקודמים. העדים החתומים: נתן הכהן ב"ר שלמה; ישועה הלוי ב"ר חלפון; שבת ב"ר אברהם ב"ר שבת; חלפון ב"ר מנשה; חלפון ב"ר ע'אלב; עלי הכהן ב"ר מנשה. ראוי להרחיב על המונח "משאעא ע'יר מקסומה" (שורה 13), שמשמעו בעלות משותפת בלתי מחולקת. בתים נהגו להיות מוחזקים בבעלות משותפת ובלתי מחולקת, כלומר החלקים בבית, שהיוו את מושא החוזה, היו יחידות חשבוניות ולא קטעים ממשיים של המבנה. בית נחלק ל-24 חלקים נומינליים, על פי דגם 24 הקיראטים או החלקים שמהם מורכב הדינר. החלקים שהועברו במכר או במתנה (שישית במסמך זה) יכלו להיות קטנים מאוד. Princeton Geniza Project description: Deed of sale of part of a house. Location: Fustat. Dated: first ten days of Iyyar 1447 Seleucid = April 1136 CE. (The date is partially preserved in l. 49 and the year appears in the small letters surrounding the signature of the judge Natan b. Shelomo ha-Kohen.). In the hand of Ḥalfon b. Menashshe. Sitt al-Banāt bt. Shelomo (Salāma) al-ʿAṭṭār inherited 1/6 of a house in the al-Mamṣūṣa neigborhood of Fustat from her late husband Abū l-ʿAlā' b. Dā'ūd. The other parts of the house are owned by the qodesh and by a Kohen known as Ibn Abū l-Khurasān. The widow sells her share of the house to David ha-Kohen for a price of 11 dinars. The buyer receives the husband's will and all former property deeds. Witneses: Natan ha-Kohen b. Shelomo; Yeshuʿa ha-Levi b. Ḥalfon; Shabbat b. Avraham b. Shabbat; Ḥalfon b. Menashshe; Ḥalfon b. Ghālib; ʿEli ha-Kohen b. Menashshe. The term "mushāʿa ghayr maqsūma" (l.13), jointly owned undivided, should be more elaborated. Houses, usually, are described as being held in joint, undivided ownership. This means that the parts of a house, which normally formed the object of a contract, were units of account, not real segments of a building. A house was divided into 24 nominal shares, a division modeled on the 24 qirats, or parts of the dinar. The shares transferred by sale or gift (a sixth in our document) could be very small.
