מסמך משפטי מבית הדין השכונתי של באב אלח'רק ואלסעאדה בקהיר, בכתב ערבי. מתוארך לי"ט רביע ב' 1056 להג'רה = 4 ביוני 1646 לסה"נ. הקאדי: מחמד זין אלעאבדין אלמרזוקי אלמאלכי. המסמך פותח בקביעה כי האישה היהודייה הרבנית חביבה בת ע'רוז בן מצבלח העניקה במתנה (תברעת) סכום של 700 מֻעַיַּנים (מן אלפצ'ה אלאנצאף אלעדדיה) לאישה יהודייה רבנית אחרת, נג'מה המכונה גם נג'ום בת ראובן בן מרדכי (روبين بن مردخاي). "מתנה" זו ניתנת בתמורה לכך שנג'ום מוותרת על זכויותיה ב-ח'לוּ, סֻכְּנא (מגורים) ואינתפאע (הנאה ושימוש) בשתי חנויות בחארת אליהוד (وذلك في نظر اسقاط حقها لها من الخلو والسكنى والانتفاع بجميع الحانوتين الكائنين بحارة اليهود) לטובת חביבה. ה-ח'לוּ הוא הזכות לבנות חנויות על קרקע הקדש (וקף) תמורת תשלום להקדש (ראו: al-Marakeby, M. Die Welt des Islams, 63(2), 184–212). המסמך ממשיך ומתאר את מיקום החנויות: האחת סמוכה לבור המים (צהריג') שבו התגורר פרג' אללה אלח'יאט, והשנייה ידועה כמקום מגוריו של סעיד בן אבו אלח'יר אליהודי אלקצאב, סמוך לשוק הדגים (סוק אלסמכ). מוזכר בו גם הוקף של המנוח עבד אלקאדר אלסמאכ. באשר לזכויות המקוריות של נג'ום ב-ח'לוּ ובאינתפאע, יש בידיה מסמך מבית דין שכונתי אחר בקהיר — אלמחכמה אלצאלחיה אלנג'מיה — שנערך תחת הקאדי המנוח מחמד ט'היר אלדין אלמחרזי אלחסיני אלמאלכי, ומתוארך לט"ו במחרם 1045 להג'רה = 1 ביולי 1635 לסה"נ. שאר המסמך כולל נוסחאות משפטיות של הודאה ושחרור הדדי. בתחתית חתומים שמונה עדים (שניים מהם חתומים גם על מסמך אחר, PGPID 31084). בראש המסמך מופיע ה-תוקיע של הקאדי וכן חותם. בגב המסמך מספר רשימות תיוק בכתב ערבי וביהודית-ערבית: - حجة حبيبة وقف عبد القادر السماك - حجة بحانوتين بحارة اليهود بجوار الصهريج بالقرب من سوق السمك باسم حبيبة - חוגת מושתרא אל דוכאניין מן נשֿמה - משה כלפון (לא ברור למה הכוונה) לתמונות המסמך ולפרטים על מקורו ראו את רשומת הקטלוג של אפרים וסט (2009).

Princeton Geniza Project description: Legal document from the neighborhood court of Bāb al-Kharq wa-l-Saʿāda in Cairo. In Arabic script. Dated: 19 Rabīʿ II 1056 AH = 4 June 1646 CE. Judge: Muḥammad Zayn al-ʿĀbidīn al-Marzūqī al-Mālikī. It begins by stating that the Rabbanite Jewish woman Ḥabība bt. غروز b. مصبلح gave (tabarraʿat) a sum of 700 medins (min al-fiḍḍa al-anṣāf al-ʿadadiyya) to another Rabbanite Jewish woman, Najma a.k.a. Nujūm bt. Reʾuven b. Mordekhay (روبين بن مردخاي). This "gift" is in exchange for Nujūm ceding her rights of khuluww, suknā (dwelling), and intifāʿ (enjoyment) pertaining to two shops in Ḥārat al-Yahūd (وذلك في نظر اسقاط حقها لها من الخلو والسكنى والانتفاع بجميع الحانوتين الكائنين بحارة اليهود) to Ḥabība. Khuluww refers to the building of stores on waqf land in return for paying money to the waqf; see al-Marakeby, M. (2021). Could Women Own Agricultural Land? One is near the cistern (ṣihrīj) where Farajallāh al-Khayyāṭ lived; the other is known as the dwelling of Saʿīd b. Abū l-Khayr al-Yahūdī al-Qaṣṣāb, near the fishmarket (sūq al-samak). There is a reference to the waqf of the late ʿAbd al-Qādir al-Sammāk. Regarding Nujūm's own original right to khuluww and intifāʿ, she possesses a document from another neighborhood court in Cairo, the Maḥkama al-Ṣāliḥiyya al-Najmiyya, drawn up under the late qāḍī Muḥammad Ẓahīr al-Dīn المحرزي al-Ḥusaynī al-Mālikī and dated 15 Muḥarram 1045 AH = 1 July 1635 CE. The remainder of this document consists of legal formulae of acknowledgment and mutual release. Eight witnesses sign at the bottom (of whom two also signed AIU XII.173 (PGPID 31084)). The judge's tawqīʿ appears at top, along with a seal.
