תיאור
ביפוליום הכולל שבעה רישומים של מסמכים משפטיים, ככל הנראה מתוך פנקס בית דין. כמה מן הרישומים מתוארכים לתשרי ה'תצ"א (ספטמבר/אוקטובר 1730). (1) המסמך הראשון בצד הרקטו עוסק בירושת אדם שנפטר בשם יהודה, ובו מאוזכרים בני משפחתו שנותרו בחיים — לפחות אחד מהם מתגורר באיסטנבול/קונסטנטינופול. מלבד האלמנה מלכה, הותיר אחריו יהודה שלוש בנות: בכורה, קאדון/קאדן(?), ובת נוספת ששמה אבד עקב נזק בשורות הפתיחה של הרישום. השם קאדון עשוי להיות תעתיק עברי של המילה הטורקית-עות'מאנית "Kadın" (אישה/גברת), בדומה לשם הפרטי הלאדינו "סניורה" המתועד אצל נשים ספרדיות במסמכי גניזה שונים מן העת החדשה המוקדמת. הצד המסכים למסמך הירושה נשא שם פרטי בצרפתית "ז'נטיל" גנטיל (נחמדה/אדיבה). על סמך הטיות הפועל בנקבה "צותה" ו"הודית", ייתכן שמדובר בבת השלישית ששמה חסר בשורות הפתיחה. (2) המסמך השני בצד הרקטו עוסק בנדוניה של וידה שרה בת משה מניין(?), ומאזכר גם את בעלה שמואל גיאטי(?). המסמך נסוב סביב בית שווידה שרה קיבלה בנדונייתה מאביה בכאניה (קאנייה) שבאי כרתים. השמות שמואל פראנקו ושמעון פראנקו מאוזכרים כבעלים של נכסים סמוכים. (3) הרישום השלישי בצד הרקטו עוסק ביישוב סכסוך בין בני הזוג מסעודה ומשה פארידיס שהופיעו בפני ר' ישועה [זי]ן(?). מובאת רשימה ארוכה של תנאים שבני הזוג מתחייבים אליהם: משה נשבע שלא להרים יד על אשתו, ומסעודה מתחייבת לא לריב עם משה, עם אמו, עם בתו מנישואין קודמים, ואף לא עם המשרתים בביתם (מאוית בצורות שונות: מנשרתים/מושרתים). התנאים מרחיקים לכת עד כדי הגבלת גישתה של מסעודה לפריטי הנדוניה שלה: היא אינה רשאית ללבוש "שום דבר מן הנדוניא ולא מן התכשיטים (joyas)", ועליה למסור את מפתח ארגז הנדוניה שלה למשך תקופה מסוימת. צד הוורסו ניזוק, ועל כן תוכן הרישום הראשון בו אינו ברור. (5-6) הרישומים השני והשלישי בוורסו מתעדים את אירוסיהם של יעקב עלוש וקמר בת יעקב זאני. לא ברור מדוע נכתבו שני רישומים — ייתכן שאחד מהם היה טיוטה. החתימות הן של "אחי החתן רחמים עלוש" ושל אברהם ברכה הלוי. (7) הרישום האחרון מתעד את נישואיהם של יוסף מטיטה(?) וחנונה בת יעקב דסא, וכולל רשימת נדוניה ובה: סנדלים, משי, רקמה ופריטים רבים נוספים.
Princeton Geniza Project description: Bifolium with seven legal document entries, likely from a court register. Dated in several entries as Tishrei 5491AM (September/October 1730 CE). (1) The first document on the recto references the inheritance of a deceased man named Yahuda whose surviving relatives are mentioned, at least one of whom resides in Istanbul/Constantinople. In addition to the widow Malkha, Yahuda left behind three daughters Bekhora, Qadon/Qadun(?), and another whose name is lost to damage in the opening lines of the entry. The name קאדון may be a Hebrew-script spelling of the Ottoman Turkish word "Kadın" (woman/lady), akin to the Ladino first name "Senyora" that is attested among Sephardi women in various early modern geniza documents. The consenting party to the inheritance document had a French-language first name "Gentil" גנטיל (kind/amiable). Based on the feminine verb conjugations "צותה" and "הודית" this could be the third daughter whose name is missing form the opening lines. (2) The second document on the recto is related to the dowry of Vida Sarah bt. Moshe Minyan[?] and also mentions her husband Shemuʾel Giyati[?]. The document centers on a house that Vida Sarah received in her dowry from her father in Chania (קאנייה) on the island of Crete. The names Shemuʾel Franko and Shimʿon Franko are mentioned as owners of adjacent properties. (3) The third entry on the recto deals with a marital dispute resolution between the spouses Masʿuda and Moshe Paredes who appeared before R. Yeshuʿa [Zay]n(?). There is an extensive list of conditions that the couple commits to, such as: Moshe vows not to raise a hand to his wife and Masʿuda commits not to quarrel with Moshe, his mother, his daughter from a prior marriage, nor their house "servants" (spelled erratically as מנשרתים/מושרתים). This may be a reference to enslaved people given that one of the legal conditions two lines later states: "and she will not demand from her aforementioned husband, that he sell any enslaved woman (שפחה) to her whatsoever" (ושלא לתבוע מבעלה הנז׳ שיקנה לה שפחה כלל). The terms also limit Masʿuda's access to her dowry items: she cannot wear "anything from the nidunya nor the jewelry (joyas)" and will relinquish the key to her dowry trunk (ארגז) for a period of time. The verso is damaged, thus the content of the fourth entry is unclear. (5-6) The second and third entries record the engagement of Yaʿacov ʿAlush and Qamr bt. Yaʿacov Zānī. It is unclear why there were two entries, perhaps one was a draft. The signatures were from "the brother of the groom Raḥamim ʿAlush," Avraham Berakha ha-Levi. (7) The last entry records the marriage of Yosef Metita[?] and Ḥanūna bt. Yaʿaqov Dasa as well as a dowry list including: sandals, silk, embroidery, and many other items. MCD.
