תיאור

שטר מתנה בכתב ידו של חלפון בן מנשה. מתוארך לשליש האחרון של חודש אדר שנת 1428 לשטרות, היינו פברואר/מרץ 1117 לסה"נ. החלק העליון של המסמך חסר. אישה ששמה לא השתמר מורישה בית, שחלק ממנו בבעלותה, לאישה אחרת בשם סת אלדאר בת שאול, ככל הנראה בתה (או אולי המשרתת המטפלת בה?). מדובר בצוואה שנעשתה "על ידי אדם בריא", ועל כן אינה ניתנת לביטול. חלק אחר של הדויירה (מתחם קטן) היה בבעלות אלעניים (העניים), כלומר של הקודש. כדי למנוע כל נזק לקודש, נאסר על מקבלת הירושה למכור את הנכס ללא-יהודים או לבנות עליו קומה נוספת. במקרה שתמכור אותו, יחולו אותן הגבלות גם על הקונה. כמו כן נקבע כי סת אלדאר תשרת את המיטיבה עמה ותדאג לה עד יום מותה. חתומים על השטר: חלפון בן מנשה הלוי, אברהם בן שלמה, יצחק בן ע'אלב החזן, משה בן עלי וחלפון בן יוסף הכהן. השטר אושר על ידי אברהם בן שמעיה החבר, מצאצאי שמעיה גאון, יצחק בן שמואל הספרדי, ואברהם בן משה.

Princeton Geniza Project description: Deed of gift in the hand of Ḥalfon b. Menashshe. Dated: last third of Adar 1428 Sel. = February/March 1117 CE. The upper part is missing. A woman whose name is not preserved bequeaths a house, part of which she owns, to another woman, Sitt al-Dar bt. Shaʾul, probably her daughter (or housekeeper?). This is a will made "by a healthy person," and therefore irrevocable. Another part of the duwayra (small compound) was owned by al-ʿaniyim (the poor), i.e. by the qodesh. To prevent any loss to the qodesh, the recipient of the estate was forbidden to sell it to non-Jews or to build an additional floor over it. In case she sold it, the same restrictions would have to be applied to the purchaser. It is also stated that Sitt al-Dār will serve and care for her benefactor until her benefactor's death.
