תיאור
העתק של שטר מתנה הנוגע לנכסים שהיו חלק מעיזבונו של המנוח אברהם קסטרו. שטר המתנה המקורי נכתב בכ' אלול ה'ת"ג (1643), ובתוספת מצוין כי ההעתק נערך בח' [שם החודש חסר] ה'תט"ז (1655/56). מקום: קהיר. על פי תיאור המסמך, חלק מהנכס כלל חדרים הפונים לחצר פנימית ולגן (חלקם הושכרו לאחרים). המונח "המרבע" משמש לאורך המסמך כדי לתאר את הנכס, ואולי הוא מציין מתחם מגורים משפחתי בצורת "ריבוע". בנוסף, היה לנכס גם דירה בקומה העליונה. בעת כתיבת המסמך המקורי בשנת 1643, מרדכי רקאק שכר נכס אחד ושמואל אבן יחיא שכר נכס אחר מתוך אחזקות הנדל"ן של משפחת קסטרו (וייתכן שהרחוב עצמו נקרא על שמם, שורה 3). יצחק בן יעקב קסטרו מסדיר העברת הנכסים במתנה לבנו התלמיד יוסף. מתנה זו חייבת להישאר בתוך המשפחה ולעבור "מיוסף לבנו ולבן בנו עד עולם, או בירושה על פי התורה". יצחק מתנה כי אין לשעבד את הנכסים כנכסי צאן ברזל בכתובה כלשהי או כביטחון לחובות. המסמך מזכיר גם את אסתר, אחותו של יצחק, אלמנתו של יוסף סעדיה, ומציין כי יוסף (קסטרו) היה גם בן אחותו של יוסף סעדיה ("בן בתו") — מה שמשמעו כי יצחק ויוסף סעדיה נשאו זה את אחותו של זה. שם אשתו של יצחק קסטרו אינו מוזכר. המסמך מתייחס למספר מסמכים קודמים שהובאו בפני הדיינים לאישור. הראשון בהם נושא תאריך יום חמישי ג' בניסן ה'ת"ב (1642), חתום בידי חביב דנון ומשה [...]. המסמך השני מתוארך לשנת 1643, חתום בידי משה ראובן הסופר, יצחק קסטרו ויהודה [...]. הדיינים שאישרו את המסמכים הקודמים הם: יהודה (?) בן חזקיהו הכהן, מנחם הכהן, ו[...] ברוך, ביום שני ח' [...] ה'תט"ז (1656) בקהיר. למסמך מבנה לא שגרתי של שורות סיום המציינות את הסופרים המקוריים, אישור תקפותו, וכן שהועתק בשנת ה'תט"ז. העדים החתומים על המסמך הם שלמה בן שמואל, סומך הכהן (סופר/מעתיק), ושלמה בן עזרא פטסו (?) .הלב(?). ייתכן ששם משפחה אפשרי זה — פטסו — הוא איות חלופי של השם המתועד (פתסו) במסמך אחר.
Princeton Geniza Project description: Copy of a gift deed concerning properties that are part of the estate of the deceased Avraham Castro. The original gift deed was issued on 20 Elul 5403 AM (1643 CE) and the addendum notes that the copy was made on 8 [month missing] 5416 AM (1655/56 CE). Location: Cairo. Based on the document's description, part of the property had rooms facing an inner courtyard and garden (some of which were rented out). The term המרבע is used throughout to describe the property, perhaps denoting a "square" family residential compound. The property also had an upper-story apartment. At the original time of writing in 1643 CE, Mordekhay רקאק was renting one property, and Shemuʾel Ibn Yaḥyā rented another from the Castro family's real estate holdings (for which the street itself was possibly named, l. 3). Yiṣḥaq b. Yaʿaqov Castro arranges for the properties to be passed on as a gift to his son, the student, Yosef. This gift must be passed down within in the family, from "Yosef to his son and to his son's son in perpetuity (עד עולם) or through inheritance on the basis of the Torah." Yiṣḥaq stipulates that the properties cannot be pledged as marital wealth in any ketubba or as collateral for debts. The document also mentions Yiṣḥaq's sister Esther, widow of Yosef Saʿadya, noting that Yosef (Castro) was also the maternal nephew (בן בתו) of Yosef Saʿadya– which means that Yiṣḥaq and Yosef Saʿadya married each other's sister. Yiṣḥaq Castro's wife is not named. This document refers to several previous documents that were brought to the judges for authorization. The first of these was dated Thursday 3rd Nisan 5402 (= 1642 CE), signed by Ḥabib דנון and Moshe [...]. The second document was dated 1643 CE, signed Moshe Reʾuven the scribe, Yiṣḥaq Castro and Yehuda [...]. The following judges approved the previous documents: Yehuda (?) b. Ḥizqiyyahu ha-Kohen, Menaḥem ha-Kohen, and [...] Barukh, dated Monday 8th [...] 5416 (= 1656 CE) in Cairo. The document has an atypical array of final lines noting its original scribes, a validation, and that it was copied in 5416 AM. The witnesses to document are Shelomo b. Shemuʾel, Somekh ha-Kohen (scribe/copyist), and Shelomo b. ʿEzra Fataso (?פטסו) .הלב(?). This potential surname פטסו may be an alternate spelling of the one attested (פתסו) in AIU VII.D.55 (PGPID 30551). (MCD with information from CUDL)
