תיאור

מסמך משפטי. הסדר שותפות. מתוארך לאוקטובר 1143. מקום: פוסטאט. נכתב בידי נתן בן שלמה הכהן. בצד הפנים (recto) נרשם הסדר השותפות, ובצד הגב (verso) נרשמו תשלומים מאוחרים יותר (חתומים על ידי חייא בן יצחק ונתן בן שלמה הכהן). השותפים, ח'לף בן אבו אלחסן אלדמסיסי ויוסף בן חסّאן אלמהדוי, נסעו למצרים העליונה כדי להפיק צבע ארגמן ולצבוע בו אריגים. ביניהם פרץ סכסוך, ייתכן שכאשר חילקו את הרווחים או ההפסדים ממכירת הצבע (שכן החלוקה אינה מפורטת במסמך). הוויתור ההדדי היה מלא, למעט תשלום של שני דינרים שעל יוסף לשלם לח'לף לפי לוח תשלומים המתואר במסמך. אם יוסף לא יעמוד בתשלום במלואו, עליו לתרום לעניים סכום זהה לזה שהוא חייב. ח'לף נחשב נאמן (כנראה ללא צורך בשבועה) בנוגע לתשלומיו של יוסף. למרות סעיף הקנס שצוין, נראה כי יוסף לקח יותר זמן מן הצפוי להחזיר את שני הדינרים, שכן הוויתור הסופי המופיע בצד הגב מתוארך לשישה חודשים לאחר סיום תקופת ההחזר של ההלוואה, בשנת 1144. Princeton Geniza Project description: Legal document. Partnership settlement. Dated: October 1143. Location: Fustat. Written in the hand of Nathan b. Shelomo ha-Kohen. The recto records the settlement of a partnership and the verso records subsequent payments (signed by Ḥiyyā b. Yiṣḥaq and Natan b. Shelomo ha-Kohen). The partners, Khalaf b. Abū l-Ḥasan al-Damsīsī and Yosef b. Ḥassān al-Mahdawī, traveled to Upper Egypt to produce purple dye and dye purple textiles. Conflict ensued, perhaps when the partners divided up profits or losses from the sale of the dye (since the division isn't specified in the document). The mutual release was complete, except for a payment of two dinars to be made from Yosef to Khalaf according to a payment schedule described in the document. If Yosef fails to make full payment, he must make a donation to the poor in the same amount as he owes. Khalaf is to be trusted (presumably, without an oath) concerning Yosef's payments. Despite the aforementioned penalty clause, Yosef apparently took longer than expected to repay the two dinars, since the final release which appears on the verso is dated six months after the end of the loan repayment period, in 1144.
